Press release: Investigation into the market of medicines

Subject: Investigation into the market of medicines and other pharmaceutical and parapharmaceutical products in the Prefecture of Karditsa

The Hellenic Competition Commission (hereinafter the “HCC”) will convene on July 2nd, 2020 to examine, based on the related Statement of Objection, the complaint of  "PHARMACY KONSTANTIA KEFALA & CO" against (a) the Karditsa Pharmaceutical Association (FSK), for violation of article 1 of law 3959/2011, as in force, and / or article 101 of the TFEU and (b) of the Cooperative Supply of Pharmacists of Karditsa P.E. (SYFAK), for violation of articles 1 and 2 of the above law and / or articles 101 and 102 of the TFEU, in the market of medicines and other pharmaceutical and parapharmaceutical products in the Prefecture of Karditsa.

According to the Statement of Objections, the violation of Article 1 of Law 3959/2011, as in force, by the Karditsa Pharmaceutical Association (FSK) is sufficiently substantiated by law, by way of conduct (other than legal), determining the opening hours of the pharmacy of the complainant from November 2011 to December 2013.

It should be noted that the Opinion is not binding on the HCC, which will decide on the basis of the available facts and the views of the parties.

In addition, according to the SO, articles 1 of L. 703/77 (current Law 3959/2011) and 81 and 82 of TEU (current art. 101 & 102 TFEU) were infringed by the supermarket chains KYPSELI S.A. (2001-2004), ALPHA-VETA VASILOPOULOS S.A. (2006-2007), SKLAVENITIS S.A. (2006), MAKRO CASH & CARRY S.A. (2006-2008) and PENTE S.A. (2006-2007).
