| Summary of Decision |
The Competition Commission cleared, pursuant to Article 8(3) of the Greek Competition Act 3959/2011, the concentration which concerns the acquisition of sole control by PEGASUS S.A. over DIMERA S.A. Even though the concentration falls within the scope of Article 6(1) of the Greek Competition Act 3959/2011 and Article 3 of Greek Law 3592/2007, it does not satisfy the provisions of Article 3(3) of Greek Law 3592/2007, in particular 35% in each of the two markets (television and newspapers) and 32% of the two markets combined, and so DIMERA will not have a dominant position in these two markets upon completion of the transaction and so it is not likely that a concentration of control will occur. |
