The Hellenic Competition Commission (HCC) has published a practical guide on resale price maintenance (RPM), i.e. the business conduct (agreement or concerted practice) whereby a supplier directly or indirectly restricts the ability of the buyer/reseller to independently determine the resale price of the products supplied and results in their resale at fixed or minimum prices. The guide explains by using examples what resale price maintenance is and how it is dealt with in competition law and in the HCC’s practice.
This guide is intended to help undertakings understand what resale price maintenance means, when and why it is prohibited, and to encourage them to assess their own behavior.
