Notice on the handling of complaints pursuant to Art. 24 of Law 703/77 and adoption of a specific Form for complaints

The Hellenic Competition Commission (HCC), after taking into account the proposal of the Directorate-General and the provisions of Law 703/77 (as amended), defined the formalities for the submission of complaints under Art. 24 of Law 703/77 regarding suspected infringements of Arts. 1 and 2 of Law 703/77 and of Arts. 101 and 102 TFEU (formerly Arts. 81 and 82 EC Treaty). For this purpose, it adopted a specific Form for complaints (Decision 473B/VI/2010).
The HCC also issued a Notice on the handling of complaints, clarifying the formalities for launching complaints before the HCC and further setting out the procedural consequences of such complaints. In addition, the Notice specifies that the civil courts are also competent to apply competition legislation, particularly with a view to safeguarding the rights of individuals. The HCC has no competence to award damages for loss incurred as a result of competition law infringements, but such claims can be pursued by interested parties before civil courts.
